Terms and Conditions
1. Overview
These Terms and Conditions ("Agreement") govern your enrollment and participation in the Create A Real Relationship ("Course") provided by Tyler Herd Speaks, LLC ("we," "us," or "our"). By subscribing to or using our Course, you ("Student," "you," or "your") agree to comply with and be bound by these terms. If you do not agree with these terms, you may not participate in the Course.
2. Free Trial
- We offer a 7-day free trial for new subscribers. The free trial gives you access to the full course content and features.
- You will not be charged during the free trial period.
- On the 8th day following your registration, your chosen payment method will be automatically charged the monthly subscription fee unless you cancel before the trial ends.
3. Subscription Plan
The Course is provided on a monthly subscription basis. By enrolling, you agree to the following:
- The subscription fee is $397, $497, or $697 per month (depending on the course option you have chosen), billed on a recurring basis every 30 days.
- Subscription fees will be charged to the payment method you provided upon registration.
- Payment is due at the beginning of each billing cycle.
- The subscription grants you access to the Course content for as long as your subscription is active.
- You can cancel your subscription at any time, as outlined below.
4. Billing and Payment
Payment Authorization: By providing a payment method, you authorize us to charge you the monthly subscription fee and any applicable taxes on a recurring basis.
Failed Payments: If a payment fails to process, we will notify you via email, and you will have 7 days to update your payment method. Failure to update your payment information may result in the suspension or termination of your access to the Course.
Price Changes: We reserve the right to change the subscription fee with 30 days' notice. You will have the opportunity to cancel your subscription before the new rate is applied.
5. Subscription Cancellation
You may cancel your subscription at any time by logging into your account or contacting us at [email protected].
No Refund Policy: Upon cancellation, you will continue to have access to the Course content until the end of your current billing cycle. We do not offer refunds or prorated refunds for partial months of service.
- After your subscription expires, your access to the Course content will be revoked.
6. Course Access, License and Intellectual Property
Upon subscription, you are granted a limited, non-exclusive, non-transferable license to access and use the Course materials for personal, non-commercial use, and educational purposes only.
Account Sharing: Access to the Course is personal to you. You may not share your account or login credentials with others.
Ownership: All Course content, including videos, documents, text, and other materials and resources are the intellectual and exclusive property of Tyler Herd Speaks, LLC. You may not reproduce, copy, distribute, modify, or publicly display any content without our explicit prior written permission.
7. Course Updates and Modifications
- We reserve the right to update, modify, or remove Course content at any time. We will make reasonable efforts to notify you of significant changes that affect your learning experience.
- Any updates to the Course content are included in your subscription at no additional cost.
8. User Conduct
By participating in the Course, you agree to:
- Not use the course materials for any commercial purpose or in violation of copyright or intellectual property laws.
- Not upload, post, or share any content that is defamatory, offensive, or violates the rights of others.
- Not engage in any activity that interferes with or disrupts the operation of the Course or the website properly functioning.
9. Termination
- We reserve the right to terminate or suspend your access to the Course at any time if you violate any part of this Agreement.
- In the event of termination due to your breach of these Terms, you will not be entitled to any refunds or compensation.
10. Disclaimer of Warranties
- The Course/service is provided on an "as-is" and "as-available" basis. We do not guarantee that the Course/service will meet your specific requirements or expectations.
- We make no warranties regarding the accuracy, completeness, or reliability of the Course content.
- We do not guarantee specific results from the use of the course content.
- You understand that participation in the course and application of the materials provided is voluntary and at your own risk.
11. Limitation of Liability
- To the fullest extent permitted by law, Tyler Herd Speaks, LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or related to your use of the Services.
- Our total liability for any claim arising under these Terms will not exceed the amount paid by you in the last 3 months of service.
12. Governing Law
- These Terms and any disputes related to your use of the Course are governed by and construed in accordance with the laws of Utah/United States of America.
- Any legal actions or proceedings related to this Agreement must be brought exclusively in the courts of Utah/United States of America.
13. Changes to Terms and Conditions
- We reserve the right to modify these Terms at any time. Any changes will be communicated to you via email or a notice on our website.
- Continued use of the Course after the effective date of such changes constitutes your acceptance of the revised Terms.
